OneGoalLimited
Please read my previous post entitled UK Mobile Scam…
I’ve been getting several hits a day from people searching for OneGoalLimited. Clearly, a lot of people are being scammed by this company. In the comments section of my previous post I’ve included information I’ve got from a WHOIS search, including the name, email address, work address and mobile phone number of the person who has registered the OneGoalLimited domain name…
Oh. OK. Here it is:
Kelly, Tony
kisu454@yahoo.com
UNIT 25 THE BRAES
Castlemilk, Castlemilk G45 9AA
GB
44.7957606683
(Note: I suspect he is no longer at that address as it is currently ‘unoccupied’.)
I spoke to ICSTIS (0800 500 212) who told me that if you’ve recieved an unsolicited text message from OneGoalLimited, you must first contact your mobile.service provider - make a note of the date and time AND the name of the person you spoke to. If after 48 hours the matter is not resolved (and it seems like in this case it won’t be), then contact ICSTIS on their freephone number (0800 500 212) and they will look into it.
Or you can just use WHOIS info to voice your displeasure.

Good on you GiaGia for taking the time to expose this con-man! One of the (many) great things about blogs is that they can help make it harder for people like this jerk to operate. It’s shameful that the phone companies don’t just starve people like him of oxygen. Why the hell does yours continue to allow him to access the network? I bet they’ve had thousands of complaints about this man and/or the companies he operates. It’s pretty poor that they are leaving it to you to deal with the problem.
Not that it’s any different with other phone companies. We missed a payment to BT a while back (after years of uninterrupted, punctual payments) and had them phoning and sending warning letters within a few days. This guy inconveniences (likely) thousands and thousands of a phone company’s customers over an extended period of time, and they take no action at all! Serious grrrr!!!

roger, because any time you contact a couple of million people, regardless of your motives, purity of essence, etc., you’re going to get several thousand complaints. Most people don’t care enough to complain properly, either. That is because most people are idiots. The phone companies, contrary to what they would have you believe, do not exist for the benefit of mankind- they exist for the simple reason of pimping your eyes and ears to the highest bidder. The calls you manage to get through only get through because at the moment you made them, you offered more money for the eyes and ears of the person you called than anyone else did.
Sorry to burst your bubble and all.

The only people OneGoalLimited should be contacting are those they have permission to contact. It’s as simple as that. If they don’t have permission, they are almost certainly breaking the rules governing their use of the network they are connecting to, not to mention marketing industry self-regulation and the now burgeoning laws regarding data-privacy. If they are breaking the rules of the network they are connecting to, it’s perfectly reasonable to expect that network to act accordingly. Besides, if a company like this is contacting “several million people”, their activities are almost certainly not legit.
The truism you state about businesses being interested primarily in making a profit adds nothing to the debate, as it’s a given. That obvious fact does not excuse phone companies, or any other type of business from acting in accordance with the norms of society, with the regulations and expectations laid down by government and their own industry, or from the expectations of their customers. There are plenty of businesses out there who act reasonably, even ethically, I fail to see why phone companies should be expected to operate any differently. And what’s more, the industry’s ombudsmen often agree with and uphold customer complaints. They don’t turn around and say “Hey, they’re flogging eye- and ear-balls, what do you expect?”.
Where industry or government inertia or apathy prevails, then doing what giagia is doing is a good way of bringing pressure to bear upon the parties concerned. Personally, my criteria for assuming idiocy is somewhat stronger than hearing that an individual has failed to complain about mobile phone network abuse in the most effective way.

The only people OneGoalLimited should be contacting are those they have permission to contact. - wrong. People have a right to talk to whoever they want, and companies have a right to solicit anyone who has not explicitly stated they do not wish to be contacted.
As to everything else- you’re wrong. Simply.

Jas, the following quote is from the TPS (Telephone Preference Service) Web site:
“New legislation, which came into force on 11 December 2003, makes it unlawful to send an unsolicited direct marketing SMS to an individual subscriber unless the recipient has previously given their consent to such communications.
Text messages are defined as “electronic mail” under the Regulations and, as such, they should not be sent without the prior consent of the individual subscribers.”

Given consent to whom? I suggest you check the small print of your contract.

Jas,
I’m with O2 and when when I agreed to the contract I currently have, I declined to tick the box that granted them permission to divulge my details to third-parties - and so far (nine months in), with a couple of exceptions, I’ve been spam-message free. I did the same with my previous airtime provider (and probably the one before that as well…)
I don’t think I know many people who agree to the “allow all and sundry to contact me” option. Anyone who does and then complains about ensuing nuisance messages, well, then I agree, they probably can justifiably be called an idiot.

“divulging [your] details to third parties” is not the same thing as granting permission to be included in electronic mailshots.

I read this blog with interest.
There seems to be lots of crooks and swindlers out there still.
I don’t believe in violence but this onegoallimited really annoyed me. I’m 47 years old and no way do I want a stupid ring tone.
I will however make sure that the £1.50 I lost today costs the proprietor a lot more than that. I believe such robbers have no right to life.
I sent this message to O2 customer service today and complained to ICSTIS.
I received a text message today from 84243 today (30/11/06) at 16.52. It cost me £1.50p from my pre-pay account. This was an unsolicited text message that I certainly would not want.
I believe this company is just a front for crooks and swindlers!
As my service Provider you have a duty of care to recover my £1.50p and close down to your network such an organisation.
Failure to do this within 21 days then I will be forced to take action myself that could include the closure of your company.
I am a qualified Electrical Engineer and don’t need to spell out the potential for your business.
Please contact me within 24 hours to let me know that you have recieved my complaint.
Yours faithfully,
Howard Askew
If they were local to me I would have been there today to imtimidate them!

Well done, Howard! …I just wonder about the huge number of people who’ve been scammed and *haven’t* complained to anyone.
I informed Watchdog about OneGoalLimited as well… maybe some more people should and they might take it up…

I ticked the box to not received any other stuff from anywhere and yet i still received it. I was mortified that it has happened to me and i hope they get what is coming to them “SOON!!!!”

I just received a message this morning from 84243 stating: “Get the new My Chemical R. -Welcome To The Black Parade. NOW reply REAL to this message to get it. Provided by onegoallimited. 08700625279 150p Stop to Stop”.
I have no idea where they got my number, nor do I know what they have charged me for the message as I am on a contract (shall obviously investigate) but the thing that really gets to me is the 150p to stop! Can they really do that? Can they charge me to stop something I never started?
(and I can gaurantee that I have NOT agreed to be contacted!)…

OK, spoke to my service provider (Orange) and they were extremely unhelpful! Not only is there nothing they can do but they can’t even tell me how much I was charged for the message “until my next statement”!
However, they did give me a customer service number to call for info on the text message (08451309911).
I called the number and after about 20 rings the phone was picked up but I was told that the Customer service department is closed over the weekend. That really blew my cap and I said some not so pleasant things along with the fact that it hadn’t stopped them sending the text message over the weekend… This seemed to change the tune and the guy checked the system and got the messaging stopped (without me having to text Stop). I received a FREE text message to say the service will be stopped within one working day (let’s just hope there are no more messages within this time frame!).
I still did not get a refund for the message received and was given another number (01494750543) to call tomorrow to request this…
Extraordinary what these people can get away with but hopefully this will be the last of it!
I have, as suggested by GiaGia, complained to Watchdog. I just hope many more do the same!

Well, I’ll say it again, companies (including ‘OneGoalLimited’) *do not* have the right to send me, or anyone else, unsolicited SMS messages (see TPS quote above). For them to have that right, I would have had to have give them explicit permission to contact me, either directly or by virtue of a contract I had signed. Neither is the case. The contract I signed with O2 does not give companies (other than O2 itself) permission to send me commercial SMS messages. If I become really paranoid, I can also withdraw permission for O2 to send me messages about their various commercial services using nothing more complex than a checkbox on an HTML form on their Web site. But in fact, they’ve sent me very little (no doubt an advantage of possessing an unfashionable marketing profile).
To be fair to O2, their marketing permissions and details dissemination arrangements are on an opt-in basis, at least, they are for the online, pay-monthly contracts. They seem to be trying to do the right thing and I’m certainly getting a lot less junk SMS and general calls than I was around two or three years ago. The reduction in voice calls, at least, is probably down to having added my mobile number to the TPS database.

The service provider has comitted an offence under the Electronic Communications Directive. Issue a claim in the small claims court (all you do is fill in a form, pay £30 and post the form). This guy won £300 for a single spam email http://news.bbc.co.uk/1/hi/world/europe/guernsey/4562726.stm

ICSTIS are a total waste of space and time and can do nothing for you personally. They’re simply like the police…they investigate the crime, but not on your behalf. Contact the Information Commissioners Office and complain. They will help you make a Data Protection Act request to find out where onegoal got your number from. If Onegoal cant prove they already had a customer relationship with you, you can take them to court like the guy did above. Usually you win £50 but the guy above was lucky and got the maximum allowed from the small claims court: £300.

I had a long exchange with my wifes service provider after a set of sms from onegoallimited. They (the service provider) would not answer my questions asking where they had got the idea of passing my pay as you go credit to a third party. Eventually they stopped talking to me and I was referred to a letter post only complaints service.
I wrote to them on her behalf asking the following (in essence)
“I want to know why you were sufficiently certain of my acceptance of an offer by onegoallimted to have passed my money to them as a third party when acting as my agent. Without referring to me.”
The key point being that you can’t just go about accepting offers on other people behalf and handing over money that you are holding effectively on trust. (Especially if you get a cut from so doing).
She got a £10 credit from the service provider and now we have £1.50 from onegoallimited. The cheque is from a company called 2Comm. All credit to the service provider, they do seem to be doing their best when dealing with what appears to be a crook. The online support was very reluctant to enter into any meanningful dialog beying cut and pasted stock respnses.
I am pursuing onegoallimited for data access and the fact that they do not appear to be DPA registered. They have not replied to my request for a datacontroller to be identified (as I think the DPA requires). I have also complained to the DPR and I am sending regular daily reminders to OneGoallimted that I would like this information.

Hi,
As I said on the other page of this blog, O2 have charged me £1.28 for my sms from OneGoalLimited.
But this scam gets better and better.
Just checked the whois for OneGoalLimited and the guy now only has an 0870 number listed:
Registrant:
Tony Kelly
UNIT 25 THE BRAES
Castlemilk, Castlemilk G45 9AA
GB
Domain name: ONEGOALLIMITED.COM
Administrative Contact:
Kelly, Tony kisu_454@yahoo.com
UNIT 25 THE BRAES
Castlemilk, Castlemilk G45 9AA
GB
+44.0870 062 5279
So if you complain to him, he’s charging you for the call! Brilliant!
I’m pursuing some of the leads others have left and will let you know how I get on.
Cheers,
Matty

Tony Kelly’s latest piece of scam artistry is buying over a flying school from fellow text scam artist Ian Vaughan (3Business, MMS3, Comms International, Mobsi) and then selling tens of thousands of pounds worth of flying gift vouchers over the Christmas period then doing a runner. Many customers and student pilots have been left out of pocket, some to the value of several thousand pounds. The saga is well documented on the aviation website http://www.pprune.com. Alledgedly BBC Watchdog are investigating!

i am astonished to find out that this spamming still continues. i just got my latest o2 bill and i have been charged £7.66 for nothing. i have registered my number to ICSTIS and hoping to get some reaction to it. they told me that the premium rate service will be stopped for me within 24 hours. although the amount is not significant i asked for a redemption and they have taken my address and said that it’ll take upto 14 days (my fingers are crossed!).
all these scams and spams make people angry and the anger is taken out on innocent people. UK has the freedom of information act but has no law to stop the crime even when they have all the information they need. i am wondering what will a person need to do to get the attention of the government.
